LOUDEN GETS 2 TO 4 YEARS

The case which attracted. the most interest and consumed the most time was that of State vs. Chester Louden,which came up for hearing Wednesday morning. It took all forenoon to procure a jury, and taking of testimony started at 1:30. This was a rape case, wherein de-atters. HENRY RATHJE ENDS OWN LIFE

Found Dead at His Home Wednesday Evening by Heide Boys. Henry Rathje of Dry Ash, was found dead at his home last Wednesday evening by his nephews, two of the Ed. Heide boys, who happened by to call on him It was a plain case of suicide, having ended his life by shooting himself with a 38 revolver, the bullet entering his mouth. He had last been seen alive last Sunday, and it is not known just when the shooting occurred. Coroner J.J.Moriarty was notified and went out Thursday morning to hold an inquest. Deceased was a single man, 66 years of age, and a pioneer resident of this section. Interment will take place at Circle Saturday.

BARN BURNS

A man by name of Schock of the Vida community had the misfortune to lose a $2,000 barn by fire one day last week. Barn had just been built. Cause of fire unknown, no insurance.

ARTHUR LARSON DIES

MRS. OGEN PASSES AWAY

The sad news of the sudden death of Mrs. Ed. Ogen of the Weldon community reached here Saturday Mrs.Ogen having passed away that morning. Mrs. Ogen while ailing for some time,was taken seriously ill on Thursday of last week, with an at-tack of kidney trouble. Deceased leaves to mourn her departure, her husband and three small children. Interment took place at Circle last Monday,Rev.Loomis officiating. The Banner extends condolence to the bereaved, in this their deep hour of sorrow.

WELL KNOWN AVIATOR HAS ACCIDENT AT GLASGOW

An aeroplane operated by Earl Vance and Jack Lawrence of Great Falls, met with an accident while doing passenger work at Glasgow re-cently. A wheel on the running gear broke off as the plane was about to leave the ground.

The nose of the plane struck the ground, smashing the propeller and damaging one of the wings. Pilot Vance and two passengers escaped unhurt.

POPLAR MAN GETS STIFF SENTENCE-20 TO 45 YEAR

Poplar, Nov. 5-In district rourt Thursday evening the case of the State vs.A. L. Gore, was concluded the man receiving from 20 to 45 years in the penitentiary. This was a stat utory offense, the plantiff being the man's own child, a 10-year-old girl,very much below the average in men-tality.

She was a pathetic figure as she sat in the witness chair and the lawyers, by slow and painful questioning elicited her story. The father is 64years old, and was tried and acquitted for the same offense in Dakota,when the child ws only six years old.Kalispell-William Bianci,work-man,injured by a falling tie,is dead.

All criminal cases were cleaned up Thursday and the Jurymen dis- mlssed. Civil actions are being trled before the judge,and will be cleaned up today or tomorrow.

Disposal of the criminal cases was as follows:

JURY DISAGREES IN FRASER CASE

The first case to come up was that of State vB.Don Fraser,on a grand larceny charge. This was a case where some cattle belonging to Mrs. Anna Bartch had ranged on an island leased by Fraser.This island. was located on the Mis-souri river and contained 177 acres.Fraser had driven the Bartch cattle together with others off the island,but kept up 18 head of the Bartch cattle, holding them for $75.00 dam-ages. A banker holding a mortgage on the cattle had offered to settle for $25.00,but this was not satisfac-tory to Fraser. Later Fraser return-ed the Bartch cattle with exception of three head, which he butchered and sold the beef,claiming he had gotten them in settlement for damages, but this Mrs. Bartch denied

BRELSFORD CASE DISMISSED

In the case of State vs.A. J. Brels-ford,who was up on a felony charge being alleged that he had carried con-cealed weapon with intent to commit assault,case was dismissed after state had introduced its evidence. This was a case which resulted from a scrap between Mr. Brelsford and G. A Vaughn,at the Paulson farm some twenty miles northeast of Cir-cle, that took place Sept. 7th over some threshing matters. It seems there had been ill feeling between these two gentlemen for some time.During this scrap Mr.Paulson testifed the first thing he seen was a rock going through the air from Mr.Vaughn towards Mr. Brelsford. Mr.Brelsford then had pulled a gun,which was taken away from him by Vaughn and Paulson. Case was dismissed on plea of self defense, and other legal technicali ties.

BUCKLEY RAPE CASE POSTPONED

The case of State vs.Otto Buckley,a rape case,was postponed until next term of court, owing to the fact th at the complaining witness, a young girl by name of Ida Burrows, wais ill and unable to be present at bearne.

Kalispell-James Davis made moonshine,drank it,and is dead as the result.

Great Falls Great Northern rail-road freight shipments are showing a remarkable increase.

MCCONE FARMER CRUSHED IN MINE

Crushed In Coal Mine Cave-in.Saved by Wife.

Wm.Vorhees, well known farmer of Nickwall community, was seriously injured last Saturday when crushed under a cave-in at a coal mine in which he was digging coal. He suf-fered a broken leg and his chest was severely crushed.

Mrs.Vorhees, accompanied her husband to the coal mine Saturday and her presence there undoubtedly saved his life. The slide of earth completely covered Mr. Vorhees and only after frantic efforts was his wife able to uncover his head. She then secured help and he was released from the cave in.

WELLIVER APPOINTED RECEIVER BROCKWAY BANK

R. L. Welliver, the local abstract man, has been appointed Receiver of the First State Bank of Brockway, by Judge F. P.Leiper.

Mr. Welliver was appointed to fill the vacancy caused by the resignation of O.A.Moxness, who is leaving for the west coast country, intending to locate out there some place.

BROTHER ACCIDENTLY KILLED

Dave James received a message Tuesday morning, to the effect that his brother Edward, who resided near Havre, had been accidently killed on Monday afternoon.

Mr. James left immediately for Havre to attend the funeral.

Great Falls Mrs.Jeanette Parker of Great Falls died from the effects of poison, taken after writing and sending a letter to her divorced husband.

Butte-Federal and police officials of Butte located along the Big Hole river near Divide 26 miles south of Butte, 110 barrels of mash, and 300gallons of moonshine.

Lewistown-William Stone, 50years of age, was killed when an auto in which he was riding with Henry Weingart, a prominent coal mine operator, went over a bank at a turn of the road a short distance east of Lewistown.

Missoula-That section of the West Gallatin highway to the north-west entrance of Yellowstone park lying between West Gallatin and Beaver creek has been completed and accepted by the bureau of public roads.

Butte-While Detectives Calpin,Rodda and Gerry were making their rounds in a police automobile about 2 o'clock the other morning, they stopped on North Wyoming street to look in on an alleged near-bear emo-rium. Hardly had they reached the door when their car was stolen.

Big Sandy-Dick Henderson of Warrick is in a critical condition from knife wounds alleged to have been received at the hands of altercation over ranch affairs, as far as can be learned, Green using his knife in the fray.
